8:30-9:30: “HR 101” (Start with the principle that employment as “at will.” What are the major statutory and common law exceptions that govern, what courts and agencies are charged with enforcing those exceptions, how do they carry out their missions, and what can an HR professional do to navigate through this complex and sometimes overlapping field).
9:30-10:15: “Legislative update” (Emphasis on the WV Safer Workplaces Act, but also the Second Chance Employment Act, Right to Work)
10:30-11:15: “The NLRB AND YOU” (Review of how the NLRB polices all workforces—not just unionized employers. Emphasis on decisions regarding the protected nature of disparaging speech, limits on confidentiality, employee right to solicit via e-mail, quickie election rule, micro-units).
11:15-12:00: “Guide to good investigations.” (How to do a good interview, who to talk to, what documents to gather, what to preserve digitally, how to write reports, how to get good statements, etc.)
1:15-2:00: “Social media Issues” (limits on policies governing off-duty use of social media, obligations to respond to off-duty harassment, bullying, etc. via social media, liability for unlawful/inappropriate use of company social media accounts and other digital communications resources, etc. )
2:00-2:45: “Wage and hour nightmares” (Proper exempt/non-exempt classification and proper distinction between contractor vs. employee, and the debacles that follow if not done right).
3:00-3:45: “Employees who really don’t want to work, but won’t go away” (How to deal with FMLA, workers comp, ADA/WVHRA, light duty, outrageous or vague physicians’ restrictions, etc.)
